Airbnb Removes Thousands of São Paulo Listings Following São Paulo Social Housing Enforcement

Airbnb has begun removing thousands of short-term rental listings in São Paulo after the city enforced restrictions preventing subsidized social housing units from being used as vacation rentals. The move follows a municipal law that prohibits properties developed under affordable housing incentive programs from being listed for short-term stays, reinforcing the city's efforts to preserve housing intended for lower-income residents.

According to reports, Airbnb has already removed 16,773 listings that fall within the affected housing categories. The removals are being carried out gradually, with the remaining listings expected to be taken offline over the coming days. Existing reservations will continue to be honored during a 45-day transition period, after which the affected properties will no longer be available for booking.

The enforcement stems from a municipal law introduced in May 2025, which prohibits units classified as Social Interest Housing (Habitação de Interesse Social, HIS) and Popular Market Housing (Habitação de Mercado Popular, HMP) from being used as short-term rentals through platforms such as Airbnb. The measure is intended to ensure that housing developed with government incentives remains available to the residents it was designed to serve.

City officials say the restrictions were prompted by a sharp increase in small apartment developments, particularly in central São Paulo and neighborhoods close to metro stations. Many of these micro-apartments were built using tax incentives aimed at expanding affordable housing but were later purchased by investors and listed as vacation rentals instead of serving low-income households.

The issue also became the focus of a municipal parliamentary inquiry (CPI), which reportedly identified more than R$5 billion in losses linked to alleged fraud and misuse of tax incentive programs between 2014 and 2025. The investigation examined whether public incentives intended to increase affordable housing had instead contributed to investment-focused developments operating in the short-term rental market.

Why It Matters for Short-Term Rental Hosts

For Airbnb hosts, vacation rental owners, and property managers operating in São Paulo, the enforcement represents a significant compliance development. Owners of units designated as HIS or HMP can no longer use those properties for short-term rental activity, regardless of whether they were legally purchased.

Hosts with affected listings should verify whether their properties fall under one of the restricted housing categories. Existing bookings made before the enforcement will remain valid during the 45-day transition period, but no new reservations will be permitted once the listings are removed.

The announcement also highlights how municipalities are increasingly scrutinizing the use of subsidized housing within the short-term rental sector. Rather than introducing a citywide ban on Airbnb or other vacation rental platforms, São Paulo's approach targets a specific category of housing developed with public incentives.

Current Status

The restriction is already in effect, and Airbnb confirmed it is working with the São Paulo municipal government to comply with the law.

According to the company's statement, the phased removal process is intended to minimize disruption for travelers with existing reservations. Airbnb also stated that it supports ensuring social housing is used by families for whom the programs were intended and will continue cooperating with the city to enforce the regulations.
