For Airbnb hosts, Vrbo hosts, and other STR operators, occupancy can depend on bedroom count, square footage, fire-safety requirements, and septic capacity. Knowing your actual limit can help you avoid unauthorized bookings and compliance problems.
The “2 guests per bedroom + 2” formula is commonly used for short-term rentals, but it is not a nationwide rule. Each city or county can establish its own occupancy requirements.
Some jurisdictions use bedroom-based formulas. Mono County, California, for example, generally uses 2 people per bedroom + 2 additional people, with a 10-person maximum unless additional building approval applies. Septic capacity can also reduce the allowed occupancy.
Meredith, New Hampshire, uses a similar 2 people per permitted bedroom + 2 additional people approach and requires the septic system to support the permitted bedrooms.
Other jurisdictions use different formulas. Rockingham County, Virginia, for example, allows different occupancy levels depending on whether the property is served by public sewer or private septic.
Occupancy may also be affected by building and fire codes. Floor area, available exits, and the intended use of a space can affect how many people can safely occupy it.

Adding more beds does not automatically increase your legal guest limit. Your approved bedrooms, property size, exits, septic system, and local STR rules may establish a lower maximum.
Your advertised occupancy should match the limit allowed by your applicable permits and regulations. If your listing promises accommodation for more guests than legally permitted, you could face enforcement action or be required to reduce the advertised capacity.
